HC issues notices to Maharishi varsity, others over illegal study centres

IN THE matter related to illegal and unauthorised act on the part of the Maharshi Mahesh Yogik Vishwavidyalaya, Jabalpur, by establishing study centers, information centres and examination centres in private institutions and coaching institutes at tehsil-level throughout Madhya Pradesh, the division bench of the Madhya Pradesh High Court, on Friday, issued notices to the Secretary, Higher Education Department, Bhopal, Secretary, University Grants Commission, Distance Education Bureau, New-Delhi, and Registrar, Maharshi Mahesh Yogik Vishwavidyalaya, Jabalpur, and asked them to file their reply before the court.
The division bench comprising Acting Chief Justice Rajendra Menon and Justice Subhash Kakade heard the public interest litigation filed by Dr B R Ambedkar Royal Society of Health and Education.
The petitioner through Advocate Imtiaz Hussain filed this PIL and contended that this petition is directed against the illegal and unauthorised act on the part of the respondent Maharshi Mahesh Yogik Vishwavidyalaya, Jabalpur, by establishing study centres, information centres and examination centres in private institutions and coaching institutes throughout Madhya Pradesh. Although, the respondent university is not authorised to open such centres beyond its campus.
The petition contended that this is indirect violation of condition by which the respondent UGC had continued recognition of the respondent university for offering programmes in Open and Distance Learning (ODL) mode for academic year 2015-16. The respondent university has created 249 associate/affiliated institutions as detailed in document and conducting ODL and examinations through them by recovering handsome fees. Thus, the university is illegally running ODL courses through its illegal associates and affiliated institutions and issuing illegal degrees to the candidates by playing fraud on them.The petitioner prayed court to call for the relevant records from respondents UGC and Maharshi Mahesh Yogik Vishwavidyalaya, Jabalpur. The results of the examination conducted in consequence of the time table be directed not to be declared and the examinations conducted beyond the campus of the respondent university at Jabalpur be declared void. The examinations due as per time-table be also declared null and void to the extent they are conducted beyond the territorial area of the Maharshi Vishwavidyalaya.The petitioner also prayed that the recognition of Maharshi Mahesh Yogik Vishwavidyalaya shall be quashed or in the alternative respondents authorities be commanded to enquire into the illegalities committed by the university within a time to be specified by this court and to take action as per law and regulations against the Maharshi Mahesh Yogik Vishwavidyalaya, Jabalpur.
